RESOLUTION 2005-6

A RESOLUTION APPROVING THE PURCHASE OF A TOWN OF SHIPSHEWANA POLICE VEHICLE TO THE TOWN OF MILLERSBURG

            WHEREAS,  the Town of Millersburg, a municipality located in Elkhart County, Indiana, is in need of a police cruiser to more effectively patrol areas located within the corporate boundaries of the Town; and

            WHEREAS, the Town Council of the Town of Shipshewana holds title to a certain 2003 Dodge Intrepid police cruiser and is willing to sell and transfer possession of said vehicle to the Town Council of the Town of Millersburg for the purpose of conducting police patrols within its Town boundaries and to more fully protect the general safety and welfare of the citizens of Elkhart County who reside within the Town of Millersburg; and

            WHEREAS, the Town Council of the Town of Shipshewana and the Town Council of the Town of Millersburg are authorized to transfer or exchange property upon terms and conditions agreed upon by said entitles pursuant to I.C. 36-1-11-8 and/or I.C. 5-22-22-10.

            NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF MILLERSBURG, INDIANA, THAT:

SECTION I

            The Town Council of the Town of Millersburg hereby approves the purchase and will accept, the transfer of title and possession of that certain 2003 Dodge Intrepid police cruiser identified by Vehicle Identification #2B3HD46V43H549185 from the Town Council of the Town of Shipshewana for the purchase price of $12,500.00 (Twelve thousand five hundred dollars) to be paid at the time of the transfer.

SECTION II

            The Town Council of the Town of Millersburg hereby delegates authority to the Clerk-Treasurer of the Town of Millersburg to pay The Town of Shipshewana the sum of $12,500.00 (Twelve Thousand Five Hundred Dollars), and sign any and all documents necessary to effectuate the transfer of the above reference 2003 Dodge Intrepid police cruiser identified by Vehicle Identification #2B3HD46V43H549185 to the Town Council of the Town of Millersburg.

SECTION III

            No part of this Resolution shall be interpreted to conflict with any local, state or federal laws, and all reasonable efforts should be made to harmonize same.  Should any section or part thereof of this Resolution be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of the Resolution as a whole, or any other portion there of other than that portion so declared to be invalid, and for this purpose the provision of this Resolution are hereby declared to be severable.

SECTION IV

            This Resolution shall be effective upon promulgation according to law.
