ORDINANCE 2003-10

AN ORDINANCE REGULATING TRAFFIC UPON THE PUBLIC STREETS

OF THE TOWN OF MILLERSBURG, INDIANA AND REPEALING ALL ORDINANCES

AND PARTS OF ORDINANCES IN CONFLICT THEREWITH

WHEREAS; Indiana Code Sections 9-4-1-13, 9-4-1-27, and 9-4-1-20 grant to the local authorities, such as the Town Council of the Town of Millersburg, Indiana, authority to establish ordinances and regulations with respect to streets and highways under their jurisdiction, which regulations and ordinances are not in conflict with the provisions of Indiana law;

WHEREAS; The Town Marshal of Millersburg, Indiana and the police department thereto have made recommendations to the Town of Millersburg, Indiana as to the establishment of regulations and ordinances with respect to streets and highways under its jurisdiction;

NOW, THEREFORE; be it ordained, resolved and established by the Town Council of the Town of Millersburg, Indiana as follows:

1. That Ordinances 2003-3, 1998-15, 1997-13, 1997-7, 1995-3, 1991-6 and 1990-12. “Appealing All Ordinances and Parts of Ordinances in Conflict Therewith”. The same hereby is, confirmed, ratified and made a part of this Ordinance as though the same were fully set forth herein.

2. That pursuit to recommendations of the Marshal of the Town of Millersburg, Indiana, and the police department thereof, the Millersburg Police Department and Millersburg Street Department are hereby authorized, empowered, and directed to place the respective traffic control devices listed on Exhibit A which is attached hereto and made a part hereof at the respective intersections or points listed thereon to regulate and control local traffic, within the jurisdiction of the Town of Millersburg, as set forth in said Exhibit A: that said traffic control devices shall be placed in accordance with Indiana Code Section 9-4-1-32, and the State manual and specifications for traffic control devices used in the State of Indiana; that from and after the date of the placement of said traffic control devices and the effective date of this Ordinance, all persons, drivers or operators of vehicles, or pedestrians, be, and the same hereby are, directed and required to obey the instructions of all such traffic control devices placed in accordance with the provisions of this ordinance and Indiana law, and should any such person disobey any such traffic control device so placed, said person shall have violated this Ordinance, and shall be subject to the penalties and forfeitures specified in the Uniform Act Regulating Traffic on Highways of the State of Indiana.

3. That all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this Ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this Ordinance.

4. That if any part of this Ordinance are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this ordinance, further, that changes in the placement and use of traffic control devices in the Town of Millersburg, Indiana are to be expected over time and amendments to this Ordinance are specifically contemplated and permitted.

5. That Ordinance violations shall be enforced under proceedings brought pursuant to Indiana Code 34-4-32-1 et seq. in a manner similar to that of infractions with complaint and summons described in Indiana Code 9-30-3-6 issued by the Millersburg Police Department or other police agencies. Any person who is found to have violated any provisions of this Ordinance shall be punished by a fine of not less than Fifty Dollars ($50.00) nor more than Five-Hundred Dollars ($500.00) for each separate offense, and fines are to be deposited into the Law Enforcement Continuing Education Fund.

6. That the Clerk/Treasurer shall certify to the passage of this ordinance and cause the same to be published, as by law provided.

7. This Ordinance shall be known as the Traffic Control Device Ordinance of the Town of Millersburg, Indiana.
