Millersburg Town Council Meeting
June 9, 2004
The regular monthly meeting of the Millersburg Town Council was held on Wednesday June 9th, 2004 at 6:30 P.M. at the Millersburg Town Hall.
James Winkler called the regular meeting to order at 6:35 p.m.
A motion was made by James Winkler to approve the minutes for May 16th, 2004. The motion was seconded by Abe Beachy and carried by a unanimous voice vote.
- Mark Grady from Quality Cablevision presented the Council with an updated with changes Cable Franchise Contract to be approved and signed between the Town of Millersburg and Quality Cablevision. Changes included: Page (6) 6.1 added entire language to Indemnification provided by Doug Hayes, the Town of Millersburg’s attorney. Deleted 6.3 entirely, Change to page (5) 4.1 to charge 3% of sales and added on page (8) 7.5 contract from 15 years to 5 years and change language from Town Trustees to Town Council, Mr. Grady wanted to change language 7.4 to cancel contract, per Doug Hayes instructions the language was kept the same. In Version 3 on page (9) added the attorney to list of people to mail to. The Clerk/Treasurer was instructed to get a clean copy of the contract from Mr. Grady with changes and distribute (2) copies to Mr. Grady (1) copy to Doug Hayes and (1) copy for the file. After much discussion James Winkler made the motion to accept the contract with changes Dean Hawkins seconded the motion and Abe Beachy voted “YES” - motion was carried by a unanimous vote.
Park
- Park Board President Lee Nisley informed the Council that the Park Summer Program was started on Monday June 7th, 2004, running from 8:00 a.m. until 11:30 a.m. and runs from Monday through Friday weather permitting.
- The subject of weather was discussed. Park Board President Lee Nisley asked the Council for their opinion on how to protect the children when storms come up during the day. The Policy is if there is a thunder storm, tornado watch or tornado warning the children is to stay home, but sometimes a storm comes up suddenly. Marshal Hathaway suggested that it be added to the contract given to the parents that the pavilion is the only protection the children have, so if a storm comes up they are required to come and get their children. President Nisley agreed that this would be the best solution.
- Council Member Dean Hawkins asked if there were any more problems with dogs messing on the ball diamonds since the signs were put up to keep dogs off the ball diamonds. . President Nisley answered that the signs are not up yet, but he had not noticed any more problems.
Water Superintendent

- Superintendent Eldridge informed the Council that he did get two quotes for body repairs on the truck. Maple City Collision for $916.00 and Gerald’s-$984.00. The issue was tabled until Superintendent Eldridge could get a quote from a person Council Member Dean Hawkins knew that did paint and repair at a better cost.
- Superintendent Eldridge informed the Council that resident Brenda Centers at 231 E. Maple Street complained to him about her driveway flooding due to the new draining on Larimer Street and wanted to know what the town could do. Council President James Winkler answered that the town could not afford to do anything about the issue at this time.
- Superintendent Eldridge informed the Council that Sprint called and informed him that the building did not have any water pressure since landlord Cecil Bontreger ran over the curb stop last year. Superintendent Eldridge would like to ask Mr. Bontreger to pay for the repair as he did the damage. The Council agreed that Superintendent Eldridge should approach Mr. Bontreger for payment of repairs.
Wastewater Superintendent

- Superintendent Eldridge informed the Council that the electric panel at the wastewater plant is so bad that the wires were burnt and sparking. A refurbished breaker was ordered. Superintendent Eldridge was told by Jim Frazell from TRAID to buy a basic cabinet and add the cost to the grant.
- Public hearing scheduled for June 23 rd, 2004 for grant resubmission.
- Superintendent Eldridge informed the Council that the Town of Millersburg did not get the grant for the wastewater project on the first round, but we will resubmit in July. Three reasons we lost the first round were: 1. most communities that are on their 2 nd & 3 rd time around on the grant gets first monies. 2. Lack of support from the public. 3. The project may not address the issue and some application questions were unanswered. Superintendent Eldridge called Senator Marvin Riegsecker and asked if he could help and he sent a letter back with his letterhead and comments.
- Superintendent Eldridge informed the Council that we did get a couple of violations from IDEM. One issue was the chlorine and ammonia from last year these have been addressed. A mistake on the paper work turned out to be a mistake in data entry on IDEM”S part. Having violations will help with getting the grant and the report will go with the next grant application.
- Superintendent Eldridge informed the Council that he needs to renew his wastewater license and he doesn’t have enough contact hours and needs to take some more training, but he can use some of his training from his other license. There is training on catch basins in Rome City on July 6th, 2004 at no cost, which would go toward Superintendent Eldridges training. The Council approved for Superintendent Eldridge to attend.
Maintenance Director

- Director King informed the Council that Mr. Sarks at 223 W. Washington requested to use another vendor for the concrete he is going to use for a new sidewalk, as this vendor is cheaper than the vendors the Town of Millersburg uses. It will take about 5 ½ to 6 yards of concrete. The Council approved for Mr. Sarks to use his vendor.
- Director King informed the Council that Matt Minch, Loss Control Specialist from Downey Insurance, did an inspection of the maintenance and street departments. There were a few small violations. MDSD needed updated and Director King updated them immediately. Signs saying “Load Limit” needed to be over the storage area. Oil drums needed labeled. The parts washer didn’t work the Council approved for Director King to get quotes for a new parts washer. The last thing was that the building needs a cabinet for all flammables. President Winkler said he would get some quotes for a new cabinet and report back to the next meeting. A response will need to be written and sent to Mr. Minch within 60 days after the inspection.
- Director King informed the Council that the work done by Mike & Teresa Roth along the drive of the maintenance building may cause a problem with deliveries due to the boulders they used. The boulders are too large and set to close to the drive. President Winkler suggested that the Clerk/Treasurer write a letter to the Roth’s asking them to move the boulders closes in on their property.
- Director King informed the Council that he was able to save money on the speed bumps the cost will be $800.00 instead of $1,500.00. Director King informed the Council that he would like to put up signs warning residents that there are speed bumps. President Winkler asked Director King were would he put the signs. Director King said on Larimer Drive about 8 to 10 ft. south of the drain and the same on Cripe Street south of the pavement entrance to Cook Station Park.

Clerk/Treasurer
- The Clerk/Treasurer presented the Council with the Fire Protection Contract with the Clinton Township Fire Department. The cost went up $1,000.00 for the 2005 year due to the cost of gas and fuel. This year’s contract was for $14,000.00 next year will cost $15,000.00. Dean Hawkins made the motion to accept the contract for 2005. Abe Beachy seconded and motion was carried by a unanimous voice vote.
- The Clerk/Treasurer presented the Council with the Contract for the elementary school crossing guard. Amy Lantz quit so a new crossing guard will need to be hired. The Clerk/Treasurer made the contract read as $9.00 to start and $9.27 in January, 2005 as the starting wage for the job is $9.00. The contract was sent to the Fairfield School Board for approval.
- The Clerk/Treasurer did the first reading of Ordinance 2004-4 an ordinance prohibiting burning in the town limits. Second and Third readings and adoption will be at the regular meeting on June 23rd, 2004.

New Business
- Deputy Clerk Branden Beachy presented the Council with the first draft of the salary ordinance for 2005. The numbers reflect a 3% increase in pay for all employees. The Council will review and report back at the budget meetings later on in July and August.
- Deputy Clerk Branden Beachy informed the Council that the wiring done by Teledata for the new backup system is done and he will put the computers in next week and the new system will be up and running. Procedures will be written on how to backup and storing backups.
James Winkler made the motion to pay bills. The motion was seconded by Abe Beachy and was carried by a unanimous voice vote
