Millersburg Town Council Meeting
April 14 , 2004
The regular monthly meeting of the Millersburg Town Council was held on Wednesday April 14th, 2004 at 6:30 P.M. at the Millersburg Town Hall.
James Winkler called the regular meeting to order at 6:30 p.m.
A motion was made by James Winkler to approve the minutes for March 24th, 2004. The motion was seconded by Abe Beachy and carried by a unanimous voice vote.
- Mary Dauwsma representing Scott Beard would like to address the Council to get permission to use a gator type vehicle to transport Mr. Beard around town. Mr. Beard is handicapped and would like to be able to get out of the house more. Marshal Hathaway suggested that he review the county and state laws regarding off road vehicles on town streets. The Council stated that they would report back to Mrs. Dauwsma at the next regular council meeting.
Park
- Council President Jim Winkler brought a request from Park Board President Lee Nisley to have the Clerk/Treasurer to take care of the deposits from the Park concession stand this summer. The Council feels that the Park Board should take of the concession stand money and deposit yet this year.
Water Superintendent
- Monthly report-See attached
- Superintendent Eldridge presented maintenance logs for the wells and tower for the Council to review. Well # 2 was pulled and fixed.
- Superintendent Eldridge would like to do an educational program with the school children for National Water Week which starts the 1 st of May.
- Superintendent Eldridge informed the Council that he will be flushing hydrants on April 20th, 21st and 22nd, 2004.
Wastewater Superintendent

- Superintendent Eldridge informed the Council that Forest River will donate $25,000.00 and Carriage will donate $20,000.00 toward a match for the Wastewater Grant the Town is pursuing.
- Superintendent Eldridge presented the Council with a copy of a letter from the County for a drainage project in Millersburg. The County gave Superintendent Eldridge a copy of the map and plans for what they want to do. Superintendent Eldridge sent a copy to the Town of Millersburg’s engineer Jim Frazell for review to make sure the plans don’t interfere with the town’s sewer system.
- IDEM made a surprise visit to the Wastewater Plant this week and did an inspection and scored the plant the highest score of (5).
- Superintendent Eldridge requested to have Friday April 30th, 2004 for a vacation day. The Council approved the request.
Maintenance Director

- Council Member Abe Beachy presented to the Council information given to him by Director King that the mower had a seal go out and might be fixed under that warranty.
- The Elkhart County Health Department has requested that the Town of Millersburg discuss and establish a plan to combat mosquito infestation. As Director King was not present the item was tabled.
Marshal

- Marshal Hathaway presented the Council with an ordinance to prohibit burning in the town limits this ordinance would replace the town’s old ordinance. The Council will review the ordinance and act on it at the next regular meeting.
- Marshal Hathaway presented a request to purchase a video system for the new Impala at a cost of $6,505.00 which would include an extra microphone. A request for a Police radio was also presented at the cost of $577.00. The Council approved both requests.
Clerk/Treasurer
- Jennifer from the Elkhart County Health Department called the Clerk/Treasurer on Friday April 2nd, 2004 and informed her that Millersburg has a rat infestation problem on S.R. 13 north. The Health Department would like for the Town of Millersburg to check areas that may attract rats, like old buildings, garbage piles and wood stacks. Council President Winkler stated that the town officials are already working with the County on the problem.
- The Petition to Vacate the Public Way of Railroad Street was filed by the Town of Millersburg’s town attorney Doug Hayes. The next step is to hold a public hearing which is scheduled for April 28th, 2004. Residents who live within 300 feet of the property have been sent a letter of notice. The notice for a public hearing will be published on Friday April 17 th, 2004 in the Goshen News and The Elkhart Truth.
Unfinished Business
- The request by Karen Fairfield to purchase an old light on the old water building was discussed and the Council decided that Mrs. Fairfield can have the light at no cost if she removes it from the building.
New Business
Abe Beachy made the motion to pay bills. The motion was seconded by Dean Hawkins and was carried by a unanimous voice vote
