Millersburg Town Council Meeting

December 22, 2003

 

The regular monthly meeting of the Millersburg Town Council was held on Monday December 22 nd , 2003 at 6:30 P.M. at the Millersburg Town Hall .

Robert Majdak called the regular meeting to order at 6:30 p.m.

A motion was made by Robert Majdak to approve the minutes for December 8th, 2003 .   The motion was seconded by Max Miller and carried by a voice vote.

 

•  Paul Miller owner of Rock Homes was present to question the connection fees for the new homes he's building on Blessing Street . Superintendent Eldridge explained the issue from his perspective. The Town of Millersburg has an agreement signed by Mr. Miller agreeing to no connection fees for houses put in place before 12-31-2002 any connected after that date Mr. Miller would have to pay a connection fee. Mr. Miller stated that he believed the ordinance meant that if he has already hooked his lines to the main, then he has already connected before the deadline. Council Member Max Miller asked that the issue be tabled until the Town Attorney could give his opinion on the issue. After much discussion James Winkler made the motion to require Paul Miller to pay the connection fees before he will be given meters for the second and third house he has put in place Robert Majdak seconded and the motion was carried by a voice vote.

•  Water Superintendent

•    Ordinances 2003-16 and 2003-17 was read and adopted. In the Water Usage Ordinance adding an inspection charge of $25.00. In the Water Rate Ordinance Section 4(a) adding a flat fee for temporary users, Section (8) adding an inspection charge of $25.00 and Section (11) adding a fine for unauthorized usage of water in the Town of Millersburg . Council Member Max Miller asked Superintendent Eldridge about the inspection charge. Council Member Miller thought that the Council had decided to charge a $25.00 fee for inspections, but the Ordinance read $30.00 for the inspection fee, after some discussion and the fact that the Ordinances had been advertised and it would cost $203.00 per ad to re-advertise Robert Majdak made the motion to pass Ordinances 2003-16 and 2003-17 as written James Winkler seconded and motion was carried by a voice vote.  

•  Council Member James Winkler brought to the floor a discussion to make corrections on the map for water service connections in the Town of Millersburg . Superintendent Eldridge informed the Council that he is working on correcting the map for locations of service connections.

•  Wastewater Superintendent

•  Superintendent Eldridge asked the Council for permission to attend a Disinfectant By -Product class on January 22nd or January 29th 2004 sponsored by the Alliance of Indiana Rural Water Association. I.D.E.M. will be the key speaker. Council approved.

•  Amy Miller representing Cornerstone Grant Management was present to explain some of the aspects of the Wastewater Improvement Grant. Mrs. Miller informed the Council on what information the Town of Millersburg would need to make the town's grant appear stronger.

•  Maintenance Director

•    Director Matt King informed the Council that the drainage project on Larimer Street was completed the week of December 15th by Beer & Slabaugh. The retaining wall at the entrance of Cook Station Park was completed also by Beer & Slabaugh the week of December 15th .

•  Robert Majdak made the motion and Max Miller seconded and motion was carried by a voice vote to approve the purchase of a new computer for the Street Department for $768.00 to be purchased from Dell Computers.

•  Marshal

•  James Winkler made the motion to approve the purchase of a new vehicle and light bar proposed by Marshal Hathaway for the Police Department Robert Majdak seconded and the motion was carried by a voice vote. The cost to be approximately $20,200.00 for the vehicle and $800.00 for the light bar.

•  James Winkler made the motion to approve the proposal for the purchase of two (2) X-26 Tasers at a total cost of $1,600.00 by Marshal Hathaway Robert Majdak seconded and motion was carried by a voice vote.

•  Marshal Hathaway informed the Council that the Police Department received $220.00 in seizure money from the County.

•  Clerk/Treasurer

•  Robert Majdak made the motion to adopt and sign Salary Ordinance 2003-14 as written for the 2004 salaries Max Miller seconded and motion was carried by a voice vote.

•  The Clerk/Treasurer informed the Council that she has received the final draw of $11,700.00 on the wastewater planning grant. The Clerk/Treasurer had three (3) days to turn the money over to TRIAD Engineering, so she wrote a check and sent it out the week of December 15th, 2003 .

•  The Council and the Clerk/Treasurer has called for a Special Meeting for Monday December 29th , 2003 at 12:00 noon to finish any end of year business. All heads of departments need to be present.

•  New Business

•  Council President Robert Majdak brought the discussion to the floor concerning a letter from Quality Cablevision. President Majdak thought it reflected poorly on the Town of Millersburg . President Majdak quoted Mr. Mark Grady's letter written to town Quality Cablevision customers and read to the public a letter from the town's perspective on the issue. President Majdak recommended that the current Ordinance be extended for three (3) months to give the new council time to look over and discuss the ordinance. Council Member Max Miller agreed that the final decision should be made by the new council. Robert Majdak made the motion to extend Ordinance 1988-6 for three (3) months with a negotiating deadline of February 29th, 2004 James Winkler seconded and motion was carried by a voice vote.

 

Robert Majdak made the motion to pay bills. The motion was seconded by Max Miller and was carried by a voice vote.
