Town Council Minutes - 02-25-02


Robert Majdak called the meeting to order at 6:35 p.m.

• Council President Robert Majdak started the meeting by mentioning that Cub Scout Pack 708 held their annual Blue and Gold Banquet at the Town Hall on Friday February 22nd, 2002. There was a good turnout and a good time was enjoyed by all present.

A motion was made by Robert Majdak to approve the minutes for February 11th, 2001. Greg Baumgartner seconded the motion and motion was carried by a voice vote.

II. Water Superintendent
• Conley Phifer from Wightman Petrie Environmental Inc. presented a map which shows the area that needs protected around the wellheads. Mr. Phifer informed the Council that all areas have been addressed at this time. Questions were asked. Council member Greg Baumgartner was concerned about the direction the aqua system runs, as to wither it could be contaminated. Superintendent Chupp said the system runs to Northwest of the Town. Superintendent Chupp informed the Council that it should not be a problem. Council President Majdak asked the Clerk/Treasurer about the Budget and how we plan to pay for the wellhead protection? Clerk/Treasurer Chupp explained that funds were available in EDIT & CCI. See attached sheet. Water Superintendent Chupp asked about progress on getting the new security system? Marshal Hathaway informed the Council that he is working with M&M Security to make changes before the final quote is presented and he will have the final quote by the next meeting. Council President Robert Majdak asked if there were any further plans to audit the wellhead plan and what would constitute an audit? Mr. Phifer informed the Council that the Elkhart County Health Department will inspect the wells every (2) years and as far as he knows the State had no plans for any audits. If an audit was needed a person would physically come out and check the facility. An inventory of the hazardous materials would be taken and any violations would be noted and followed up on. Any new facilities must apply to the Elkhart County Health Department and be inspected.

• Superintendent Ronald Chupp presented fence quotes as part of the Wellhead Protection Plan project. Custom Fencing at the cost of $2,700.00 and Allied Fence, LLC at the cost of $2,850.00. Superintendent Chupp recommended Custom Fencing. Robert Majdak made the motion to accept Superintendent Chupp’s recommendation Max Miller seconded the motion and motion was carried by a voice vote.
• Superintendent Ronald Chupp presented quotes to abandon the two test wells as part of the Wellhead Protection Plan project. North American Pump Co. at the cost of $1,625.00 and Top Flight at the cost of $2,268.00. Superintendent Chupp recommended North American Pump. Robert Majdak made the motion to accept Superintendent Chupp’s recommendation Greg Baumgartner seconded the motion and motion was carried by a voice vote.
• Discussion of wellhead protection meeting on February 13th, 2002. Meeting minutes are attached. A letter was hand carried to each household asking that residents within the wellhead protection area check their property for contaminants. See attached letter.
• Superintendent Chupp would like for the minutes to reflect a change in the date for the water/sewer line maps completion provided by Wightman Petrie, Inc. originally scheduled for March 11th, 2002 has been rescheduled for April 22nd, 2002.
• Paul Miller was invoiced for his share of the moving the hydrant on Blessing Street and payment was received. See attached invoice.


III. Wastewater Superintendent
• Superintendent Eldridge received a quote from Triad for an income study at a cost of $1,600.00 or $900.00 if the Town of Millersburg would do the mailing of the survey. Council member Greg Baumgartner made the motion that Mr. Hornsby conducts the full survey Robert Majdak seconded the motion and motion was carried by a voice vote. President Majdak asked how long would the survey take? Superintendent Eldridge informed the Council that the public would have the survey in 30 days and Mr. Hornsby should be finished in 60 days. Resident Vickie Archer asked why we needed an income survey? President Majdak answered that it needed for grant purposes.
• Update on WWTP maintenance project. Wastewater Superintendent Eldridge informed the Council that he is able to use the land application the Town has which will save about $30,000.00. Superintendent Eldridge informed the Council that he could eliminate Sherry Labs cost of $1,200.00. Merrill Brothers came and pumped out the large digester on Monday February 25th, 2002. They will come a second time to clean and repair the digester. Council President Majdak asked Superintendent Eldridge to adjust his timeline for repair and cost. President Majdak then will meet with the Clerk/Treasurer and make adjustments before his meeting with the Credit Union. The County Commissioners drew up the Declaratory Resolution and the T.I.F. district is in place. The annual tax income will be approximately $15,000.00 per year for (5) years.


IV. Maintenance Director

• Work order updates. See attached report. Director Beachy was asked what happened to requisition #1070 and he said never received the requisition. President Majdak asked that the requisition be reissued under a new number. Requisition #1069 was not completed due to the weather. It needs to be cold so the reed-beds are not so slushy. Requisition #1069 will be finished next week when the weather is cold again per Director Beachy.


V. Marshal
• President Robert Majdak asked the Marshal if there had been an update on the cell phone situation? Marshal Hathaway answered that he had gotten in touch with a new person whom he felt was more dependable and who did correct things immediately. President Majdak asked that the Marshal gave another update on the cell phone situation at the next meeting.
• Marshal Hathaway and M&M Security toured the buildings this week and rethought things concerning the security systems. The Town Hall will be the central location and will increase the quote $2,500.00. Council member Greg Baumgartner asked that another quote be obtained just to compare and make sure the Town isn’t going to pay too much for a security system. The Marshal agreed to seek another quote and present it at the next meeting.


VI. Clerk/Treasurer
• The Clerk/Treasurer would like to attend the Ball State School continuing education classes on Tuesday March 12th and Wednesday March 13th, 2002 in Muncie Indiana. The cost will be $175.00 plus a room for two nights and food. Council approved.
• The Clerk/Treasurer would like to attend a seminar on PERF retirement qualifications that will be held on Thursday March 14th, 2002 in Bourbon Indiana. Council approved.


VII. New Business
• The Clerk/Treasurer presented the Council with bankruptcy papers for the Russell Yates account #00-00085-04-1 in the amount of $106.57 to be written-off. The Clerk asked for the Council’s approval. A motion was made by Robert Majdak to approve the write-off. Greg Baumgartner seconded the motion and motion was carried by a voice vote.

Robert Majdak made the motion to pay bills. The motion was seconded by Greg Baumgartner and was carried by a voice vote.
