Town Council Minutes - 01-28-02


Robert Majdak called the meeting to order at 6:30 p.m.

A motion was made by Robert Majdak to approve the minutes for January 14, 2002 with corrections. Max Miller seconded the motion and motion was carried by a voice vote

• Discussion of changes made to the Rate and Usage Ordinances after publication.
1. Ordinance 2002-1 Water Rates. The item C “Equivalent Dwelling Unit” in section 3 was taken out. Section 4 (b) “(10) days from the due date” was changed to state (15) days.
2. Ordinance 2002-2-Water Use. Section 2.08 the Town of Middlebury was changed to state the Town of Millersburg.
3. Ordinance 2002-3-Section 3 “User charge” read that for a 6” water meter the cost would be $403.86 should state $403.06. Section 3 C “Casual User” states a charge of $6.29 per (100) gallons should state per (1,000) gallons. Section 4 read tap fee for sewer at a cost of $1,168.00 should state $600.00. Section 12 was taken out.
4. Ordinance 2002-4 stayed as advertised.
• First and second reading of ordinances 2002-1, 2002-2, 2002-3 and 2002-4 concerning water and sewer rate increases and water & sewer department policies.
• Paul Miller-discussion of grandfathering connection fees. A letter was sent to Paul Miller reminding him that he has not signed the agreement between himself and the Town of Millersburg concerning grandfathering connection fees and waving of tap-on fees. See attached letters. Mr. Miller was present and made an appeal to the Council for a twenty-four (24) month exemption from the new connection fees. The original agreement was for fourteen (14) months, which would expire December 31, 2002. After much discussion Council President Robert Majdak made the motion to stay with the original agreement of fourteen (14) months Greg Baumgartner seconded and motion was carried by a voice vote.

II. Water Superintendent
• Paul Miller and Council President Robert Majdak signed an agreement on Tuesday January 15th, 2002. The agreement states that Mr. Miller would get a utility maintenance bond for his subdivision and Mr. Majdak would sign off on the Plat presented. See attached document.
• A utility maintenance bond from Mr. Miller was faxed to the Town Hall on Friday January 18th, 2002. See attached.
• The Council requested that Superintendent Ronald Chupp have the information for location of water valves, etc. to Wightman Petrie, Inc. by March 11th, 2002. Maintenance Director Abe Beachy’s information he has collected concerning location of valves will be used.
Wightman Petrie, Inc. is to have the updated maps done by March 25th, 2002.
• The next wellhead protection meeting is set for February 13th, 2002 at 6:00 p.m. at the Town Hall.


III. Wastewater Superintendent
• Superintendent Ben Eldridge reported to the Council that reed beds are no longer allowed at wastewater plants. Superintendent Eldridge is not sure of the alternatives at this time.


IV. Maintenance Director
• Discussion of new requisition procedures. Tabled.


V. Marshal
• The Council gave its approval of the agreement to combined the responsibilities of the Marshal’s Clerk with the janitorial position. See attached agreement.


VI. Clerk/Treasurer

Ordinances 2002-1 water rate increase and 2002-3 sewer rate increase where published on Friday January 18th, 2002. See attached advisement. Meeting dates where also posted at (3) places in the Town limits. FBCU bank, Post Office and the Town Hall.


VII. New Business

Max Miller made the motion to pay bills. The motion was seconded by Robert Majdak and was carried by a voice vote.
