RESPONSIBILITIES FOR THE TOWN OF MILLERSBURG EMPLOYEES

RESOLUTION 2001-3

RESOLUTION ELECTING TO INCLUDE CLERK/TREASURER
POSITION IN THE PUBLIC EMPLOYEES’ RETIREMENT FUND

WHEREAS, The Town of Millersburg, is the governing body of the Town of Millersburg in Elkhart County in the State of Indiana, and

WHEREAS, the actuary for the Public Employees’ Retirement Fund has furnished such governing body with certain cost estimates to become a participant in such Fund as established by the Acts of 1945, Chapter 340, and all Acts amendatory and supplemental thereto and

WHEREAS, such governing body is fully cognizant that the percentage of cost of gross annual payroll of covered employees has been set at 4.75__and $__-0-___ by the actuary of the Fund, and that at five year intervals, or more often if directed by the Board of Trustees of the Public Employees Retirement Fund, the actuary will review the status of the employees covered and shall adjust the cost percentage accordingly so that the FUND will remain on an actuarially sound basis, and

WHERAS, such governing body acknowledges its liability and that, pursuant to law, it and its successors in office, must appropriate sufficient funds each year to retire the employees’ prior service liability in an orderly manner and also fund the current cost accruing annually.

NOW THEREFORE, BE IT ORDAINED by the governing body of the
Town of Millersburg in Elkhart County, in the State of Indiana:

SECTION ONE: The Town Council of Town of Millersburg elects to enlarge its participation in the Public Employees’ Retirement Fund by including additional classes of employees as stated below in the coverage under Chapter 340 of the Acts of 1945, all Acts amendatory and supplemental thereto, This agreement supplements the original dated __July 1, 1986____.

SECTION TWO: The Town of Millersburg ______ agrees to make the required contributions under the Public Employees’ Retirement Fund Act, which is the Act of 1945, Chapter 340, and all Acts amendatory thereof and supplemental thereto, including specifically the Acts of 1955, Chapter 329, commonly designated as “The Indiana Public Employees’ Social Security Integration and Supplemental Retirement Benefit Act.”

SECTION THREE: The position Clerk/Treasurer is declared covered by the Fund.

SECTION FOUR: It is hereby declared that none of the classifications or positions specified in Section three are compensated on a fee basis or of an emergency nature, or in a part-time category.

SECTION FIVE: The active participating membership of the Town of Millersburg shall begin on July 1, 2001.

SECTION SIX: This Resolution shall be in full force and effect from date of passage and upon approval of the Board of Trustees of the Public Employees’ Retirement Fund of Indiana, except that active participating membership shall begin on the date set forth in Section Five.

Transfer of Funds Resolution 2001-4

Whereas, it has been determined that it is now necessary to transfer money from the listed over-appropriated funds to the listed under-appropriated funds;

Be it ordained by the town council of the town of Millersburg, Indiana that for the expenses of the Town Government, the following appropriations are hereby transferred and set apart out of the funds hereinafter specified for the purposes specified, subject to the laws governing the same, such sums herein transferred unless otherwise stipulated by law.

ORDINANCE NO. 2001-5


AN ORDINANCE RESTRICTING WATER AND SEWER
CONNECTIONS IN NEW RESIDENTIAL SUBDIVISIONS


WHEREAS, the Town of Millersburg has heretofore authorized the operation and construction of a waterworks plant and a sewage treatment plant, and is the body charged with regulating the connection of additional users to Town water and sewer utilities: and


WHEREAS, the Millersburg Town Council considers it desirable to limit the number of housing units hooked up to the water and sewer utilities to as to avoid exceeding the capacity of such utilities: and


WHEREAS, Indiana Code §§ 36-1-3-1, et seq. permits any town in the State of Indiana to exercise any power or any function necessary to the public interest in the context of its municipal or internal affairs, which is not prohibited by the Constitution of the United States or the State of Indiana, or denied or preempted by any other law, or as not expressly granted by any other law to another governmental entity; and


WHEREAS, the Town Council of the Town of Millersburg is the Town legislative body and is by law authorized to adopt ordinances and resolutions for the performance of functions for the Town of Millersburg and its water and sewer utilities;


NOW, THEREFORE, BE IT ORDAINED by the Town Council of the Town of Millersburg, State of Indiana, as follows:


Section 1. No lot in a residential subdivision, the plat or re-platting of which receives final approval on or after the effective date of this ordinance, shall be permitted to connect to the Town’s water or sewer lines unless such residential lot has an area of at least 10,000 square feet, has a minimum lot width of 90 feet, and a minimum lot depth of 90 feet.


Section 2. This Ordinance shall be effective upon its passage by the Millersburg Town Council.

ORDAINED AND ADOPTED this 12th day of March, 2001.

Salary Ordinance 2001-6

LET IT BE KNOWN, that the Town Council of the Town of Millersburg, IN, agrees to the salaries and benefits established for the year 2001 listed below, further details being provided on attached spreadsheets.

All full time employees shall receive 8 paid Holidays, including 1 floating Holiday, Health Insurance, Public Employees Retirement Fund as their pension and paid vacation per the Personnel Policy.

The Clerk-Treasurer will pay payroll by-weekly and there are 26 pay periods in 2001. The Council will be paid on the last payroll of the month. Council approval of salary vouchers will be the first regular meeting of the month following payment of these claims.

Health S Life Insurance will be paid for by the Town of Millersburg, except for the employee’s share, which is 5% for the year 2001, with 1/26th of said percentage being deducted each pay period.

The Marshal shall receive $824 for clothing allowance. The balance of which will be added to his salary at the end of the year

The Superintendent, Maintenance Director, and the Marshal to accumulate a two-hour minimum time worked, on after-hours calls.

Compensatory Time will be computed on a 40-hour workweek including holidays, vacation, & sick time.

All personnel will be reimbursed 31 cents a mile for work related travel in personal vehicles.

Resolution 2001-13

RESOLUTION TO THE TOWN COUNCIL OF THE TOWN OF MILLERSBURG,
INDIANA, AUTHORIZING THE APPROPIATION OF INTEREST EARNED IS
DEPOSITED INTO THE WASTEWATER OPERATING FUND.

WHEREAS; The Wastewater department has experienced a decline in incoming funds causing financial difficult,. The Town Council of the Town of Millersburg has determined it necessary to appropriate the interest earned from the money market account, savings account and checking account be put in the wastewater operating fund for the period commencing September 1, 2001 until December 31, 2003, a period of two (2) years and four (4) months, to increase the operating funds of the wastewater department.

ADOPTED by the Town Council of the Town of Millersburg, Indiana this 24 day of September 2001.

Resolution 2001-14

A RESOLUTION TO RELIEVE THE WASTEWATER TREATMENT PLANT FROM PAYING THE WATER DEPARTMENT A WATER BILL AND RELIEVING THE WATER DEPARTMENT FROM PAYING THE WASTE WATER DEPARTMENT A SEWER BILL.

WHEREAS; The Town Council of the Town of Millersburg, Indiana deems it necessary to relieve the Water Plant from paying a sewer bill to the Wastewater Plant and the Wastewater Plant from paying a water bill to the Water Plant.

Be it ordained by the town council of the town of Millersburg that for the period beginning October 2001, and ending December 2003, the Millersburg Water Department shall not charge the Millersburg Wastewater Department for water used, and the Millersburg Wastewater Department shall not charge the Millersburg Water Department for sewage treatment.

ADOPTED THIS 24th DAY OF September, 2001
