Whereas, It has been determined that it is now necessary to appropriate more money than was appropriated in the annual budget; now, therefore:


Section 1
: Be it ordained by the Town Council of the Town of Millersburg, Indiana, Elkhart County, that for the expenses of the taxing unit the following additional sums of money are hereby appropriated out of the funds named and for the purposes specified, subject to laws governing the same:

Ordinance 1989-3

AN ORDINANCE TO REMOVE THE WATER UTILITY FROM THE JURISDICTION
OF THE INDIANA UTILITY REGULATORY COMMISSION

WHEREAS, the town of Millersburg is a town located in the State of Indiana; and WHEREAS, the town owns and operates a water utility pursuant to IC 8-1.5; and

WHEREAS, IC 8-1.5-3-9.1 allows the town, by ordinance, to remove its municipally-owned utility from the jurisdiction of the Indiana Utility Regulatory Commission for the approval of rates and charges and of the issuance of stocks, bonds, notes or other evidences of indebtedness; now therefore,

BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MILLERSBURG:

Section 1. That the town of Millersburg, being the owner of a water utility, hereby elects to remove said utility from the jurisdiction of the Indiana Regulatory Coin mission.

Section 2. This ordinance takes effect 60 days after adoption by the Board of Trustees of the town of Millersburg, unless a petition is filed under IC 8-1.5-3-9.1(d).

Ordinance 1989-4

An Ordinance supplementing previously passed Ordinance No. 1977-6 concerning the construction and operation by the Town of Millersburg Sewage works, the issuance of revenue bonds to apply on the cost thereof and other matters connected therewith.

WHEREAS, the Town of Millersburg has heretofore passed Ordinance No. 1977-6 and now wants to supplement Section 22(a) of said Ordinance dealing with covenants pledged to the United States of America, acting through the Farmers Home Administration; now, therefore.

BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF MILLERSBURG, IN.

So long as said bonds are outstanding, the Town covenants to the holders, their successors and assigns, that in addition to the other covenants, terms, and conditions applicable to the bonds authorized by this ordinance, that the Clerk-Treasurer shall maintain a fidelity bond in an amount as specified in Section 22(a) of Ordinance No. 1977-6 dated 12-5-77

Ordinance 1989-5

BE IT ORDAINED by the Board of Trustees of the Town of Millersburg:

Section 1. The following described real estate is hereby annexed to and incorporated into the Town of Millersburg Elkhart County, State of Indiana to—wit:

A part of the Northeast Quarter of Section Township 36 North, Range 7 East, Clinton Township, and more particularly described as follow

Commencing at a P. K. nail marking the Southeast corner of said Northeast Quarter; thence North 89 degrees, 23 minutes West,, 336.51 feet along the South line of said Northeast corner to a rebar marking the point of beginning of this description; thence continuing along the last described line and bearing 1025.6 feet to an iron stake; thence North 00 degrees, 44 minutes East,, 743.27 feet to an iron stake; thence South 89 degrees,, 23’minutes East, 1025.6 feet to an iron stake; thence South 00 degrees 44 minutes West,. 743.27 feet to the point of beginning, containing 17.56 acres.

Section 2. The Clerk-Treasurer is directed to publish this ordinance as required by Law and to furnish a certified copy of the same to the Auditor of Elkhart County The Board of Commissioners of Elkhart County and the Elkhart County Plan Commission.

Section 3. This Ordinance shall be in full force and effect 60 days following the date of the last publication.

Ordinance 1989-6

BE IT ORDAINED by the Board of Trustees of the Town of Millersburg:

Section 1. The following described real estate is hereby annexed to and incorporation into the Town of Millersburg Elkhart County Indiana to--wit:

Beginning at a point 5.41 chains North of the point where the present north corporate limits of the Town of Millersburg intersects the center line of Benton Street (also known as State Road 13), being also 11.51 chains South of the Northwest corner of the Southwest Quarter of Section 35, Township 36 North, Range 7 East; thence South 5.41 chains to said corporate limits; thence East along the corporate boundary line 20 chains; thence North 5.41 chains; thence west 20 chains to the place of beginning, containing 10.8 acres more or less.

Section 2. The Clerk/Treasurer is directed to publish this ordinance as required by law and to furnish a certified copy of the same to the Auditor of Elkhart County, The Board of Commissioners of Elkhart County and the Elkhart County Plan Commission.

Section 3. This Ordinance shall be in full force and effect 60 days following the date of the last publication.

Ordinance 1989-8

Be It Ordained by the Town Council of the Town of Millersburg:

Section 1: That in the central business district of Millersburg, being defined as Washington Street between Clinton Street and the North-South alley East of Jefferson Street, and Jefferson Street from Lincoln Street to the East-West alley North of Washington Street, there is established four parking spaces for handicapped parking.

Section 2: The Town Marshal shall conduct a survey of business and public facilities and based upon that survey shall designate the spaces to be reserved for handicapped packing.

Section 3: The Town Marshal shall procure signs bearing the official international wheelchair symbol conforming to state standards as to size and shall erect the same immediately at the reserved space.

Section 4: Any person who parks a motor vehicle which does not display a handicapped person’s or disabled veteran’s placard, issued under I.C. 4-28-10-24, I.C. 9-7-4 or I.C. 9-7-4.1-1, shall upon conviction be subject to a fine not to exceed Five Hundred Dollars ($500)

Section 5: Any person using a handicapped parking space shall conform to all other ordinances and regulations as to time and snow removal now in effect or hereinafter adopted.

NOW THEREFORE, BE IT ORDAINED by the Council of the Town of Millersburg, Elkhart County, Indiana:

That the Personnel Policies Ordinance 1986-5 shall be amended to read as follows:

That the term “Town Board of Trustees” is replaced with “Town Council”

That Section 4.4 HOLIDAYS shall read:

The Town of Millersburg shall pay employees for each of the designated holidays at their regular straight time hourly base rate. When the holiday falls on a Sunday, the Town shall grant the following Monday as the holiday. When the holiday falls on a Saturday, the Town shall grant the proceeding Friday as the holiday. If the holiday occurs during a vacation, an additional day may be added to the vacation. Full time employees shall be granted (8) paid holidays per year as follows: New Year’s Day, Good Friday, Memorial Day, Independence Day, Labor Day. Thanksgiving Day, Christmas Day, and a Floating Holiday. The Floating Holiday can been take whenever an employee wishes, but must be approved in advance by the Town Council and within the Department no more than one (1) employee off during the Floating Holiday. If an employee works on any holiday, he may take another day off at the same rate of pay. No Holidays shall be carried to the following calendar year.
